Man to court over flying golf balls
A resident of a Vanderbijlpark golf estate has complained to the North Gauteng High Court in Pretoria that stray golf balls hitting his home are dangerous.
Eric Schoeman approached the court for an interdict that would force the Emfuleni Golf Course’s owners to stop people playing on its 14th hole, The Star reported today.
Schoeman said the green was only 10 metres from his home, which he considered highly dangerous because the house and living area were often hit by golf balls.
When Schoeman bought his home on the estate, he said the owner had verbally assured him the green would be moved further from his property.
The golf course was subsequently sold and the new owner, SY Kim, said this was not provided for in the sale agreement.
Kim contended the matter should have been dealt with in arbitration, rather than legal processes.
Judge Natvarlal Ranchod requested that the parties submit oral evidence at a later date.
